Although Snow teeth whitening kits and products are manufactured in FDA-approved facilities, they are over-the-counter products classified as cosmetics. For this reason, they and similar competitor products are not approved by the FDA. 


Snow Whitening Lawsuit: What Happened?

In December 2020, lawyers for Mr. Burton Kraus filed a false advertising class-action lawsuit against Snow Teeth Whitening LLC. 

It claimed that the Snow teeth whitening kit’s LED technology was ineffective and no different to similar, cheaper systems, therefore heavily overpriced. Furthermore, it claimed that the defendant (Snow) suggests that the light system will protect customers from Covid-19 germs and infection.

The lawsuit initially also named Floyd Mayweather and Rob Gronkowski as defendants. However, the court later ordered their names to be removed as they only appeared in product advertisements and weren’t involved in any business or strategic decisions regarding the company.

During deposition, the defendant’s lawyers determined that the plaintiff, Burton Kraus, had bought the whitening kit only after Snow had rejected a settlement demand. They also established that he had, in fact, not seen any of the “misleading” advertisements referred to in the lawsuit. 

In August 2021, Snow Teeth Whitening LLC filed a motion to dismiss because the defendant had no prior experience of the teeth whitening kit before joining the class action suit, and had admitted not having seen the advertisements cited in the lawsuit. An outcome to this motion is yet to be determined.


Is Snow Teeth Whitening Safe?
